Section 106 of the National Historic Preservation Act gives Tribal Nations, communities, state and local governments, property owners, experts, and the public a voice before infrastructure projects damage or destroy the places that carry our shared history. Today, Section 106 is under attack from three fronts simultaneously: a proposed regulatory rewrite that would transfer power from the public and Tribal Nations to federal agencies and developers; congressional proposals that would weaken the statute; and executive actions that test ways to evade or narrow the law on highly visible projects.
